The Supreme Court sitting in Abuja has struck out an ambush by the lawyers to Obaseki’s candidates pleading the Court to dismiss the main appeal by the Legacy candidates.
In a move to get the case struck out through technicalities, the candidate representing Esan North East state Constituency 1, who was voted in by the Legacy delegates, brought a sponsored motion to strike out the entire Appeal on the ground that he did not brief the Legacy lawyers to add his name as an Appellant.
But the same person’s name had appeared as an Appellant in the Legacy candidates lists in the High Court and Appeal Court without objection from him.
Sensing that their case at the Supreme Court will definitely collapse on merit, the Obaseki’s candidates’ lawyers brought in a motion through a proxy lawyer to strike out the entire Appeal.
The Supreme Court judges unanimously held that the name of the Appellant be struck out from the list while the case will proceed.
The court also granted leave for all parties to file all necessary documents before the next adjourned date.
The Court however consolidated all the appeals on both sides into single appeals and adjourned the case to Thursday, 26th January for a definite hearing.
