The High Court of Justice in the Federal Capital Territory (FCT) has issued an order preventing Senator Samuel Anyanwu from parading himself as the National Secretary of the Peoples Democratic Party (PDP).

Recall that Truth Live News had reported that the Peoples Democratic Party (PDP) gubernatorial candidate in the just concluded Imo State Guber election has returned to his duty as the National Secretary of the party.

But, a new twist has set in as the Federal High Court sitting in Abuja have a retraining order preventing Anyanwu from assuming duty as National Secretary.

This ruling, handed down by Justice M. M. Adamu, responds to a motion filed by PDP member Douglas Nwachukwu through his legal representative, F. S. Jimba Esq., dated October 30.

The court’s decision bars Senator Anyanwu from performing the responsibilities associated with the role of the National Secretary of the party. This directive echoes a similar order from a high court in Enugu, reinforcing the legal pressure on Senator Anyanwu to step down from his position.

Nwachukwu’s motion sought specific reliefs, including an interlocutory injunction restraining the PDP and its entities from recognizing or dealing with Senator Anyanwu as the National Secretary until the substantive suit is resolved. Another injunction prohibits Senator Anyanwu from acting in the capacity of the National Secretary during this period.

Barrister Jimba successfully argued the case, leading to the court’s decision. The court explicitly stated, “This application succeeds, and the Orders are hereby granted as prayed,” confirming the interlocutory injunctions against both the PDP and Senator Anyanwu.

The court’s directive extends to disallowing any form of recognition, acceptance, or interaction with Senator Anyanwu as the National Secretary of the PDP until the substantive suit sees resolution. The next crucial date in this legal dispute is scheduled for January 24, 2024, when further proceedings are set to take place.

The legal battle unfolds under the case filed in the High Court of Justice, Federal Capital Territory, Abuja Judicial Division, with the matter listed as FCT/HC/M/015/23. The court order, issued on November 10, 2023, carries implications for the future leadership dynamics within the PDP, pending the resolution of the substantive suit.
