JUST In: Court Fixes Date To Hear EDSG Case Against Shaibu’s Reinstatement

A Federal High Court sitting in Abuja, presided over by Justice James Omotosho, has scheduled September 24 for the hearing of two separate motions filed by the Edo State Government and the House of Assembly. These motions challenge the reinstatement of Philip Shaibu as deputy governor.

The motions were filed by the state’s Attorney General, Oluwole Iyamu, SAN, and the House of Assembly’s lawyer, Ken Mozia, SAN, on July 18. They seek orders to stay the execution of the judgment that reinstated Shaibu and to restrain him from performing duties as deputy governor pending the determination of their appeals.

Justice Omotosho had previously voided Shaibu’s impeachment on July 17, citing procedural lapses in the assembly’s actions. The upcoming court session will address the state’s arguments that the judgment should be suspended to prevent disruption in the government’s operations and due to Shaibu’s declared support for a rival political party.
