NBA Benin Condemns Edo Assembly’s Suspension of Council Chairmen

The Nigerian Bar Association (NBA), Benin Branch, has expressed deep concern and dismay over recent events in Edo State government, describing them as a disregard for the rule of law.

In a statement released on December 20, 2024 and signed by the chairman, the association condemned the suspension of democratically elected local government chairmen by the Edo State House of Assembly on allegations of misconduct. The NBA-Benin cited the Supreme Court ruling in Attorney General of the Federation v. Attorney General of Abia State & Ors (2024) LPELR-62576 (SC), which reaffirmed the autonomy of local governments, urging all stakeholders to adhere strictly to the law.

“The proper channels exist for investigating the financial state of Local Government Councils,” the statement read. “We call on the Attorney General and other justice administrators to advise appropriately, ensuring the rule of law remains supreme.” The association called for restraint, emphasizing that actions outside legal provisions undermine democratic principles.

The NBA-Benin also decried the reported harassment of Mr. Wole Iyamu, SAN, a former Attorney General of Edo State, by non-state actors at the premises of the High Court. Allegedly, the incident occurred under the pretext of retrieving state property.

The association criticized the usurpation of law enforcement roles, particularly within judicial premises, labeling it as unacceptable. “We urge the Edo Commissioner of Police to investigate this incident thoroughly and ensure those responsible are held accountable,” the statement continued.

The NBA-Benin reaffirmed its commitment to justice and accountability, vowing not to tolerate any violation of individual rights, particularly against its members.
