Firm Sues Glo Mobile, NCC Over Alleged $10m Contract Breach

A Nigerian consultancy firm has taken telecommunications operator Glo Mobile, the Nigerian Communications Commission (NCC) and Megatech Engineering Limited to court over an alleged breach of a multi-million-dollar consultancy agreement.

Mosakab Nigeria Limited and its promoter, Mashood Mustapha, filed the suit at the Federal High Court in Abuja, seeking more than ₦20bn in damages.

They accuse the three defendants of violating a 2017 agreement tied to the sale and allocation of a 2.6GHz spectrum licence.

The plaintiffs claim they were contracted by Megatech in 2017 to help secure a national 2.5/2.6GHz spectrum licence from the NCC, a process they say required substantial financial and technical input. Their efforts, they argue, led to the NCC issuing Megatech a 40MHz spectrum offer in March 2020.

According to the court filings, Megatech later opted to share the spectrum with Glo Mobile, a move the plaintiffs say they facilitated using their industry contacts. But they allege Megatech failed to pay the agreed $10m consultancy fee, releasing only $421,052 and leaving an outstanding balance of over $9.5m.

Mosakab also claims Megatech sold its interest in the spectrum to Glo without settling the outstanding payment. They are asking the court to invalidate the transaction, revoke the spectrum licence and compel Megatech to honour all financial and equity commitments.

In addition to the unpaid balance, the plaintiffs are demanding ₦5bn for breach of contract, ₦10bn in general damages and an order compelling Megatech to allocate 5–10% of its outstanding shares to Mustapha.

Megatech, Glo Mobile and the NCC have not yet publicly commented on the case.

Meanwhile, the suit, marked FHC/ABJ/CS/1534/2024, has been assigned to Justice Mohammed Garba Umar, who is expected to begin hearing the matter on 3 March 2026.
