In the suit filed by Nnamdi Kanu, leader of the Indigenous People Of Biafra, IPOB, against the Department of State Services, DSS, the Federal High Court sitting in Abuja has reportedly fixed 20th of June, 2023 for the adoption of processes.
The date, in the absence of Justice Binta Nyako, of whom it was said to have gone on official duty was on Monday fixed by the court registrar.
In the suit number FHC/ABJ/CS/2341/2022, Kanu had asked the Court for permission to apply for an order of mandamus to compel DSS to allow him access to his medical doctor.
Recall that on February 1, after an ex-parte motion by Ozekhome, Kanu was granted permission by the court to apply for an order of mandamus.
The DSS, who in a preliminary objection prayed Court in the suit number FHC/ABJ/CS/1585/202, between Kanu and the DG of DSS and two others to dismiss the suit for want of jurisdiction, insisting that on the 3th of June, 2022, there was a sister judgement delivered by Justice Taiwo Taiwo.
The judge had, on May 3, reportedly warned lawyers for DSS and Kanu against truncating proceedings on the next adjourned date.
NAN reports that Nyako gave the warning following a proceeding that could not go on due to an oral application by DSS counsel, Idowu Awo seeking more time to respond to a further affidavit serve on him by Kanu’s lawyer, Mike Ozekhome SAN, in the open Court.
Truth Live News learned that the instant suit was similar to the earlier one and that Kanu had filed an appeal against the judgement.
